The terms on which we provide our brokerage services and this website.

In short: Always Charter is an air charter broker — we arrange private flights for you with independent, licensed air carriers. We are not an airline and we do not operate aircraft. This page explains the rules for using our website and the basics of how we work with you. When you book a flight, the details are governed by our separate Charter Broker Agreement, which you'll review and sign for each trip.

About these Terms

These Terms of Use ("Terms") govern your access to and use of the website at [alwayscharter.com] and any related pages, tools, or content we provide (together, the "Site"). The Site is operated by Always Charter, LLC, an Oregon limited liability company ("Always Charter," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who we are — a broker, not an airline

Always Charter is an air charter broker. When you ask us to arrange a flight, we act as your agent to source aircraft, negotiate with carriers, and arrange your charter with an independent air carrier that is licensed and certificated to operate the flight.

  • We do not own, operate, lease, or control any aircraft.
  • We are not a direct air carrier, indirect air carrier, or foreign air carrier, and we do not hold an FAA air carrier certificate.
  • The operating carrier ("direct air carrier") has complete operational control of every flight and is solely responsible for the safe operation of the aircraft, its crew, maintenance, and compliance with all aviation regulations.

How booking works

Anything you see on the Site — including sample aircraft, routes, and indicative pricing — is for information only and is not an offer or a confirmed booking. Aircraft availability and pricing change constantly.

To book a flight, we provide a written Charter Quote and a Charter Broker Agreement for that specific trip. Your booking is governed by that Agreement and the Charter Quote, not by this website. If anything on the Site appears to conflict with your signed Charter Broker Agreement, the Agreement controls.

Regulatory disclosures (U.S. DOT — 14 CFR Part 295)

As a U.S. air charter broker, we make the following disclosures, and provide the trip-specific details in your Charter Quote before you contract:

  1. Our status and capacity. Always Charter acts as an air charter broker and as your agent in arranging your flight. We are not a direct or indirect air carrier.
  2. Who operates your flight. We disclose the corporate name of the operating direct air carrier (and any name it uses publicly) in your Charter Quote before you book, and we notify you if the carrier changes.
  3. Insurance. We disclose the existence or absence of any liability insurance held by Always Charter covering the charterer, passengers, and property, and its limits. The operating carrier maintains its own aviation liability insurance; a certificate is available on request.
  4. Available on request, before you contract: the total cost of the transportation (including all broker- and carrier-imposed fees and government taxes and fees); any third-party fees (such as fuel, landing, or hangar fees); and any business relationship between Always Charter and the operating carrier that could affect our carrier selection.

Using the Site

You may use the Site only for lawful purposes and in line with these Terms. You agree not to:

  • use the Site in any way that breaks applicable law or regulation;
  • copy, scrape, reproduce, or republish any part of the Site except as allowed below;
  • interfere with or disrupt the Site, its security, or its underlying systems;
  • attempt to gain unauthorized access to any part of the Site or related accounts;
  • use the Site to transmit malware, spam, or misleading, harmful, or infringing content; or
  • misrepresent your identity or impersonate any person or entity.

We may suspend or terminate your access to the Site at any time if you misuse it.

Intellectual property

The Site and its content — including text, graphics, logos, the "Always Charter" name and marks, layout, and software — are owned by Always Charter or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site for your own non-commercial purposes. All other rights are reserved. You may not use our names or logos without our prior written permission.

Quotes, pricing, and information accuracy

We work to keep the Site accurate and current, but we do not warrant that any content — including indicative pricing, aircraft details, or availability — is complete, accurate, or up to date. Any advertised or displayed prices are indicative only; binding pricing is provided in your Charter Quote and includes applicable taxes and fees as required by law.

Third-party links and content

The Site may link to third-party websites or contain content from third parties (for example, operators, mapping, or payment providers). We provide these for convenience and do not control or endorse them, and we are not responsible for their content, products, privacy practices, or availability. Using third-party sites is at your own risk and subject to their terms.

Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that it is free of viruses or other harmful components.

Nothing on the Site is legal, tax, financial, or safety advice.

Limitation of liability

Because we act only as a broker, our role and responsibility are limited to arranging your charter. Anything relating to the flight itself — safety, delays, cancellations, injury, or property loss — is the responsibility of the operating carrier, and the limitations and terms of your Charter Broker Agreement apply to bookings.

To the fullest extent permitted by law, Always Charter and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed US $100. Liability relating to a booked flight is governed instead by your Charter Broker Agreement. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

Indemnity

You agree to indemnify and hold harmless Always Charter and its members, managers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules, and applicable U.S. federal law. Any dispute relating to the Site will be handled as set out in our Charter Broker Agreement where one applies; otherwise, you agree to the exclusive jurisdiction of the state and federal courts located in Oregon. Disputes relating to a booked flight are governed by the dispute-resolution terms of your Charter Broker Agreement.

International users

We operate from the United States. If you access the Site from outside the U.S., you do so on your own initiative and are responsible for compliance with your local laws. Our handling of personal data — including for users in the EU, UK, and elsewhere — is described in our [Privacy Policy].

Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above, and material changes take effect when posted. Your continued use of the Site after changes means you accept the updated Terms.
